Participation in the erotikcafe.com services is governed by the following terms and conditions of erotikcafe.com. These terms and conditions are currently available in German. By registering with erotikcafe.com and using the services offered, the participant declares that they will use the erotikcafe.com services in compliance with applicable law and these General Terms and Conditions.
Certain erotikcafe.com services may only be used after registering as a participant. Any person who completes the registration form fully and truthfully ("Registration Data") may become a participant. The participant subsequently receives a pseudonym and a password ("User Data"). The participant is obliged to keep their Registration Data up to date. The participant must keep their User Data confidential. Registration is free of charge. Each participant is permitted to hold only one membership and to utilize the associated benefits. Membership—and the associated erotikcafe.com services—may be used exclusively for personal purposes and is non-transferable. erotikcafe.com does not store the contractual terms individually for each participant. Participants may access these General Terms and Conditions via a link located in the service area of the website.
Minors may register for free erotikcafe.com services that require registration, provided that they are aware of the consequences of consenting to the processing and use of their data, that they understand the significance of such consent, and that the use of the specific service by minors is not expressly prohibited elsewhere in these terms. Use of the erotikcafe.com services is at the users' own risk. erotikcafe.com assumes no liability for ensuring that the erotikcafe.com services are available at all times—without interruption, in a timely manner, securely, and free of errors. erotikcafe.com assumes no liability for any information or data belonging to the participant that is lost. Information and advice received by a user in connection with the erotikcafe.com services—whether via websites, email, fax, in writing, or verbally—shall not constitute any warranty on the part of erotikcafe.com, unless expressly agreed otherwise.
erotikcafe.com may, at its sole discretion, determine which services are made available and to what extent. Restrictions, expansions, and other changes to these services
a) erotikcafe.com is entitled to terminate the contract regarding the participant's use of the erotikcafe.com services at any time, effective upon one month's notice, via email. Furthermore, erotikcafe.com is entitled to terminate the contract without notice for good cause, without prior warning. Good cause shall be deemed to exist, in particular, if the participant violates applicable law or these General Terms and Conditions.
b) The participant may terminate their participation with erotikcafe.com at any time. If the participant deletes their account, all data will be removed from the database. It will then no longer be possible to restore the account.
c) Upon the effective date of termination, erotikcafe.com shall have the right to delete any data that the participant has posted to or received via the erotikcafe.com network.
d) Any remaining Coins held at the time of deletion shall expire and cannot be paid out.
Furthermore, erotikcafe.com reserves the right to delete inactive accounts that have not been used for a period of 30 days and have never purchased any Coins. p9@@Free Community Services
With regard to the email service, the participant is subject to the following obligations in particular:
a) not to use the email address for the retrieval or dissemination of information that is contrary to public morals or unlawful; b) to observe applicable regulations regarding the protection of minors; c) to respect the privacy of others and, therefore, under no circumstances to send harassing, defamatory, or threatening content via email or SMS; d) not to execute any applications that could lead to an alteration of the physical or logical structure of the networks being used. The use of the email inbox for sending mass emails/mass SMS messages (spamming), mail bombing, and any other form of advertising or marketing messages is prohibited and renders the participant liable for any resulting damages. The foregoing provisions regarding the email service apply in full to SMS-based email services as well. It is hereby expressly clarified once again that our service allows real persons to get to know and meet one another. Our service is not merely a purely moderated service. A fictitious profile (regardless of gender) may be operated by either a male or a female moderator. Moderators—or, more precisely, fictitious profiles—are under no obligation, during a dialogue with a member, to disclose that they are not real persons, as every statement made is, as described above, entirely fictional, and this fact is set forth in these General Terms and Conditions (GTC). Upon registration, every member confirms that they have read and understood these GTC.
Effective communication among participants, as well as optimal utilization of the erotikcafe.com services by individual users, presuppose that participants treat one another with respect and adhere to certain rules of conduct. This entails that participants must not express themselves in a manner that is injurious, defamatory, offensive, threatening, obscene, racist, or otherwise unlawful or contrary to public morals—whether in emails, posts regarding erotikcafe.com surveys, chat rooms, conferences, or personal ads ("Participant Pages"). Participants undertake to show consideration for the cultural and religious sensitivities, as well as the opinions, of other participants. The erotikcafe.com Participant Pages are intended to provide private individuals with a forum for expressing opinions, forming views, and getting to know one another. Right of Withdrawal
You may revoke your contractual declaration within 14 days without stating any reasons, in text form (e.g., letter, fax, email). The revocation period begins upon receipt of this instruction in text form, but not before the conclusion of the contract, nor before the fulfillment of our information obligations pursuant to Article 246 § 2 in conjunction with § 1 Para. 1 and 2 of the Introductory Act to the Civil Code (EGBGB), as well as our obligations pursuant to § 312 e Para. 1 Sentence 1 of the Civil Code (BGB) in conjunction with Article 246 § 3 EGBGB. Consequences of Revocation
In the event of an effective revocation, the services received by both parties must be returned, and any benefits derived (e.g., interest) must be surrendered. If you are unable to return the received service and benefits (e.g., benefits of use)—either wholly or partially—or if you can return them only in a deteriorated condition, you must, where applicable, provide us with compensation for the value thereof. This may result in your remaining obliged to fulfill the contractual payment obligations for the period up to the revocation. Obligations to reimburse payments must be fulfilled within 30 days. For you, the revocation period begins upon the dispatch of your revocation notice or of the item; for us, it begins upon receipt thereof.
Special Notes
Your right of revocation expires prematurely if the contract has been fully performed by both parties—at your express request—before you have exercised your right of revocation.
